There have been a lot of blogposts, views, opinions and news stories about the recent decision to repeal IPC Sec 377 from the Indian constitution. I did not bother about this till today when a friend asked me on gtalk what I thought of this decision. I admitted that I did not know about Sec 377 of the IPC. That is when he explained that it was about the sexual preferences and homosexuality being legalized in India. Being frank, that does not make any difference to me if it were legal or illegal and I was not knowing till date that it was illegal to have sex with a person of the same gender as yours.

I did a wiki search and this is what I got! AFAIK, this section talked about having sex as illegal, but that is not the same as treating homosexuals as illegal. And let us all admit something here.. haven’t we done anything illegal at any point of time?? Be it jump a traffic signal or more commonly, overtake another vehicle from the left side or drive without seat belts or ride without helmets or swear aloud at some other vehicle??? If you look at the legality of all these things, none of us can be spared from the “extended” arm of the law. So, why could we not leave it at it and why did we make that a big hue and cry??

As per Wikipedia, Sec 377 is as follows:

377. Unnatural offences: Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for term which may extend to ten years, and shall also be liable to fine.

This contains the following points to be noted:

1. Voluntary carnal intercourse
2. Against the order of nature

I’d love to check the Govt’s view of the “order of nature”.

We have the Kamasutra which says men can sleep with men and so can women sleep with women. If the Kamasutra, which was, is and probably still would be considered the treatise/encyclopedia for sexual relations contained information about Sexual freedom, why the bloody fuck are we not considering it as normal?

Another point to be noted: This Sec 377 of the IPC is into effect from 1860. It is more than 60 years since India got its independence. Why are we still acceding to a law that was made just after the First war of Indian Independence? Also, I read somewhere that Lord Macaulay, the person who drafted, moderated and passed this law had given a press release that the only thing that would allow the British to gain complete access over the Indians were to break the education habits of the Indians. I am not claiming that it is true. Nor am I going to say that it might just be a farce. Let Lord Macaulay be where he is, hell or heaven, he wud be knowing by now!!!

Agreed for a seemingly “straight” person like you or me, being homosexual and having sexual relations with a person of the same gender seems odd. That just means that we are being biased in our feeling. I would like everyone to realize that though people might be homosexual or have sexual relations with a person of their own gender, they are basically human beings. And they are not having sexual relations in public. Whatever happens in their lives between closed doors / in their bedrooms or during their private moments, is their personal and private lives. Nobody better have any say on it, as long as it is “voluntary”.

Lemme classify the sexually different beings into the following categories, which is all known earlier. I want to give my opinion on all the four:

1. Gay: In normal parlance, this means males having sexual relations with males. This might be due to either a psychological feeling or this might even mean that the males are very very comfortable with each other. Why is it wrong?? I have one of my childhood friends who is gay and is proud to be gay. And I don’t have any problems interacting with him. Of course, it is against nature for a male to insert his genital into another males arse. But hell, come to terms.. there is a hole, there is a pole and the pole gets into the hole. Why are we so much bothered as to what gender the hole is and what gender the pole is???
2. Lesbian: In normal parlance, this means females having sexual relations with females. This might again be due to either a psychological feeling or some averse feeling towards males. This actually means that girls have all the freedom in their life to sleep with another girl. Of course, it would be odd to note that there are just holes and no poles, but hell.. as long as they are comfortable and happy and satisfied, why are we bothered?
3. Transgenders: Some have holes, some have poles, but the people with holes do not have the balls and the people with the poles cannot use the balls. What is the big deal? However, I admit that the background of a transgender is still a mystery, but what the heck? They are transgenders.
4. Straight: All those people who have sexual relations with mutual genders, males with females and vice versa. Effectively, the hole and the pole belongs to two different genders. So, the society considers this normal! At the end of it, the society is looking into the private lives of the individuals, without the individuals coming to know of this.. Is this worth it???

There were transgenders in our mythology too.. remember Shikhandi of Mahabharata??? Actually Mahabharata contained Gays too.. remember Uttara Kumara, the son of Duryodhana!!! And it is a well known fact that it contained Lesbians too.. Remember all the girlfriends / wives of Krishna??? You think he would have been able to spend time always with all of them at the same time? Effectively, IMHO, they were fulfilling their desires themselves. What is the big deal???

I would still say that you treat them as individuals.. have you seen dogs do it??? The female dog will be screwed initially and the sexual frenzy would not let the other dogs control their feelings and they do the male dog. If this is not homosexuality, what else is? This is bisexuality at its best.
